1. Acceptance of Terms

By downloading, installing, or using the LevinGPT mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you ("User," "you," or "your") and LevinGPT ("we," "us," or "our").

2. Description of Service

LevinGPT is an AI chat application that runs a large language model (Google Gemma 2B) entirely on your iOS device. The App provides:

• AI-powered conversational assistant
• Document analysis (PDF reading)
• Image text extraction (OCR)
• Conversation history management
• Offline functionality

Key Feature: All AI processing happens locally on your device; no external servers are used for AI inference.

3. Eligibility

Age Requirements

• You must be at least 12 years old to use the App
• Users under 18 must have parental or guardian consent
• Parents/guardians are responsible for minors' use of the App

Device Requirements

• iOS 17.0 or later
• iPhone 12 or newer
• Minimum 8GB free storage space

4. Account & Registration

No Account Required: LevinGPT does not require account creation or registration. You can use the App immediately after installation.

Apple ID: Subscriptions are managed through your Apple ID and subject to Apple's terms and conditions.

5. License & Usage Rights

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the App on your personal iOS devices
• Use the AI model included with the App for personal purposes
• Store conversations and files locally on your device

Restrictions

You may NOT:

• ❌ Reverse engineer, decompile, or disassemble the App
• ❌ Extract or attempt to extract the AI model
• ❌ Use the App for illegal purposes
• ❌ Resell or redistribute the App or AI model
• ❌ Use the App to generate harmful, illegal, or abusive content
• ❌ Attempt to bypass usage limits or subscription requirements
• ❌ Use the App for automated/bulk processing beyond personal use
• ❌ Share or distribute AI-generated content that violates others' rights

6. Subscription Terms

Free Tier

• Included: 3,000 tokens upon installation
• Purpose: Trial of all features
• Limitations: Limited to 3,000 tokens total
• Ads: May display advertisements via Google AdMob

Paid Subscriptions

Subscription Management

• Managed through Apple App Store
• Cancel anytime via iOS Settings → [Your Name] → Subscriptions
• Cancellation takes effect at end of current billing period
• No refunds for partial subscription periods (per Apple policy)
• Auto-renewal can be turned off at least 24 hours before renewal

Price Changes

• We may change subscription prices with 30 days' notice
• Existing subscribers maintain current price for the billing cycle
• New price applies upon renewal after notice period

Free Trial (If Offered)

• If a free trial is offered, it will be clearly disclosed
• Trial converts to paid subscription unless canceled before trial ends
• Only one free trial per Apple ID

7. Payment Terms

Processing

• All payments processed by Apple Inc.
• Subject to Apple's In-App Purchase terms
• Prices shown include applicable taxes
• Currency based on your Apple ID region

Refunds

• Refund requests must be made to Apple, not to us
• Apple's refund policy applies
• We have no control over Apple's refund decisions
• To request refund: reportaproblem.apple.com

Taxes

• You are responsible for any applicable taxes
• Prices may vary by jurisdiction

8. AI-Generated Content

User Responsibility

You are solely responsible for:

• ✅ Verifying accuracy of AI-generated information
• ✅ Using AI content appropriately and legally
• ✅ Not relying on AI for critical decisions (medical, legal, financial)
• ✅ Respecting others' intellectual property rights
• ✅ Complying with all applicable laws

No Professional Advice

AI-generated content is NOT:

• Medical advice or diagnosis
• Legal advice or opinion
• Financial advice or recommendation
• Professional consultation of any kind

Always consult qualified professionals for important decisions.

Content Filtering

We implement content filters to reduce inappropriate outputs, but no filter is perfect. If you encounter problematic content:

• It's not intentional on our part
• You can report it to us
• We'll work to improve filters
• Continued use is at your discretion

9. Intellectual Property

Our Rights

We (and our licensors) own all rights to:

• The LevinGPT App and its code
• App design, graphics, and user interface
• LevinGPT name and branding
• Documentation and marketing materials

AI Model License

• The Gemma 2B model is licensed from Google
• Subject to Google's Gemma Terms of Use
• You receive right to use, not ownership

Your Content

• You retain ownership of content you create or upload
• We don't claim ownership of your conversations
• You grant us no rights (since we don't access your content)

AI-Generated Content

• Ownership of AI-generated content is complex and evolving
• We don't claim ownership of AI outputs
• You should not assume you own AI-generated content
• Consult legal advice for commercial use of AI outputs

Trademarks

• "LevinGPT" and our logos are our trademarks
• You may not use our trademarks without written permission
• Apple, iPhone, iOS are trademarks of Apple Inc.
• Google, Gemma are trademarks of Google LLC

10. Privacy

Your privacy is important to us. Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

Key Points:

• All AI processing happens on your device
• We don't collect your conversations
• Minimal data collection (subscription status, optional crash reports)
• No tracking beyond optional ads for free users

11. Prohibited Uses

You agree NOT to use the App to:

Illegal Activities

• ❌ Violate any laws or regulations
• ❌ Infringe intellectual property rights
• ❌ Engage in fraud or deception
• ❌ Harass, threaten, or harm others

Harmful Content Generation

• ❌ Create content promoting violence or terrorism
• ❌ Generate child sexual abuse material (CSAM)
• ❌ Produce spam or malware
• ❌ Create deepfakes or misleading media

Service Abuse

• ❌ Attempt to hack or compromise the App
• ❌ Bypass usage limits or security measures
• ❌ Overload or disrupt App functionality
• ❌ Scrape or extract data beyond personal use

Consequence: Violation may result in immediate termination of your license without refund.

12. Disclaimers & Limitations

AS-IS Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• No warranty of accuracy or reliability
• No warranty of fitness for particular purpose
• No warranty of merchantability
• No warranty of uninterrupted or error-free operation

AI Limitations

We specifically disclaim responsibility for:

• ❌ Accuracy of AI-generated information
• ❌ Quality or appropriateness of AI outputs
• ❌ Decisions made based on AI content
• ❌ AI model performance or speed
• ❌ Storage capacity limitations

Service Availability

• We don't guarantee uninterrupted service
• The App may have bugs or errors
• Updates may temporarily disrupt service
• We may discontinue the App at any time

Third-Party Services

• We're not responsible for Apple's App Store policies
• We're not responsible for Google's ad network
• Third-party services have their own terms

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR:

• ❌ Indirect, incidental, or consequential damages
• ❌ Lost profits, data, or revenue
• ❌ Personal injury or property damage
• ❌ Reliance on AI-generated content
• ❌ Service interruptions or errors
• ❌ Data loss due to device failure

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid us in the 12 months before the claim (likely $2.99-$24.99).

Exceptions: Some jurisdictions don't allow limitation of liability for personal injury or death. In those cases, this limitation doesn't apply to such claims.

14. Indemnification

You agree to indemnify and hold us harmless from:

• Claims arising from your use of the App
• Your violation of these Terms
• Your violation of others' rights
• Content you create or distribute

This means you'll cover our legal costs if we're sued due to your actions.

15. Termination

By You

• Delete the App anytime
• Cancel subscription via Apple (takes effect at period end)
• No penalties for termination

By Us

We may terminate your access if you:

• Violate these Terms
• Use the App illegally
• Abuse or exploit the service

Effect: Upon termination:

• Your license to use the App ends immediately
• No refund for remaining subscription period
• You should delete the App and all associated data

16. Updates & Modifications

App Updates

• We may update the App with bug fixes, improvements, or new features
• Updates may change functionality
• You should keep the App updated for best experience
• Older versions may stop working

Terms Updates

• We may modify these Terms at any time
• Material changes will be notified via in-app message
• Continued use after changes = acceptance
• If you don't agree, stop using the App

17. Apple-Specific Terms

Acknowledgment

You acknowledge:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support
• Apple is not responsible for the App
• Apple is not responsible for addressing claims

Scope of License

• License is non-transferable
• Limited to use on Apple-branded products you own/control
• Subject to App Store Terms of Service

Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them.

18. General Provisions

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the rest remains in effect.

Waiver

Our failure to enforce any right doesn't waive that right.

Assignment

You may not assign these Terms. We may assign them to a successor entity.

Force Majeure

We're not liable for delays or failures due to circumstances beyond our control.

Language

English is the controlling language. Translations are for convenience only.

No Agency

These Terms don't create a partnership, agency, or employment relationship.
